(a) Whenever any bicycle is, or in-line skates (roller blades) are operated by any person, including minors under the age of eighteen years, in violation of any of the provisions of this chapter, such person’s bicycle or in-line skates may be seized by any member of the Police Department and impounded for a period not to exceed thirty days. Such bicycles or in-line skates shall be released at the discretion of the Chief of Police to the parent or guardian of any mninor, without charge, only after a full explanation to such parent or guardian of the reason for such impounding and after the expiration of the impounding period. Such remedy shall be in addition to the penalties provided in subsection (b) hereof.

(b) Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
