440.01 LOAD LIMITS.
   (a)   State Routes. No person shall operate or move a vehicle or combination of vehicles of a size or weight of vehicle or load exceeding the maximum specified in Ohio R.C. 5577.01 to 5577.09, inclusive, or otherwise not in conformity with Ohio R.C. 4513.01 to 4513.37, inclusive, upon any State route within the Municipality, except pursuant to special written permit issued by the Ohio Director of Transportation. Every such permit shall be carried in the vehicle or combination of vehicles to which it refers and shall be open to inspection by any police officer.
   No holder of a permit issued by the Ohio Director of Transportation shall be required to obtain any local permit or license or pay any local fee or charge for movement on any State route within the Municipality. However, no person shall operate any such vehicle or combination of vehicles upon any roadway within the Municipality which is not a State route, except as may be otherwise provided in any local ordinance or regulation or elsewhere in this Traffic Code.

   (b)   Local Streets. No person shall drive or operate, or cause to be driven or operated, any vehicle used for the transportation of goods or property, the gross weight of which, with load, exceeds five tons, upon the streets, bridges and culverts within the Municipality except on designated and marked State and Federal routes, temporary or permanent. Drivers of such vehicles whose gross weight, with load, exceeds weight limits prescribed by this chapter may deliver or pick up goods or property at places not located on State or Federal routes provided such vehicles are only operated by the shortest way possible between the State or Federal route and the place of delivery or pickup or as otherwise directed by a police officer.

   (c)   No person shall drive or operate or cause to be driven or operated any vehicle the gross weight which, with load, exceeds ten tons upon Wally Road between State Route 3 and West Main Street within the Village, with the exception of vehicles making deliveries and pickups on such portion of Wally Road. The Commissioner of Streets is hereby authorized to post load limit signs upon Wally Road within the Village.
   (d)   The legal weight limit on the Union Street Bridge on State Routes 3 and 60 is hereby reduced forty percent for total weight and axle loads. The Chief of Police is hereby ordered to post such Bridge with appropriate signs warning of such reduced load limit.
   (e)   (1)   Whoever violates any of the provisions of subsection (a) or (b) hereof shall be guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
      (2)   Whoever violates subsection (c) or (d) hereof is guilty of a misdemeanor of the fourth degree.
