432.44 TRACKING OF DIRT, MUD, ETC.
   (a)   No person shall operate any vehicle or conveyance upon any street or sidewalk within the Village with dirt, mud, sand, rubbish or any other offensive substance on its wheels or other parts, if such operation results in the depositing or tracking of such dirt, mud, sand, rubbish or offensive substances upon the streets or sidewalks of the Village.
   
   (b)   No owner of real property or a prime contractor in charge of a construction site shall maintain such property or construction site within the Village so that vehicles upon such property or construction site pick up dirt, mud, sand, rubbish or any offensive substance on their wheels or other parts and deposit or track such dirt, mud, sand, rubbish or other offensive substance onto the streets and sidewalks of the Village.
   (c)   Where dirt, mud, sand, rubbish or any offensive substance has been tracked or deposited upon any street or sidewalk of the Village in violation of this section, the Mayor is hereby authorized to cause such dirt, mud, sand, rubbish or offensive substance to be cleaned from such street or sidewalk and to charge the cost thereof to the person or persons responsible. The cost of cleaning shall be collected by civil suit.
   (d)   The term “responsible person”, as used in this section, means the driver of the vehicle which deposited or tracked the dirt, mud, sand, rubbish or offensive stance on the street or sidewalk, or his employer or the owner of real property or a prime contractor in charge of the construction site from where the deposited or tracked dirt, mud, sand, rubbish, or offensive substance on the street or sidewalk originated.

   (e)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
