It is the intent of this Section to establish standards for the installation of driveways and other points of access onto public streets so as to protect the traveling public from traffic hazards.
(a) In areas zoned residential under the current Village zoning regulations, one driveway per lot shall be permitted. Additional driveways may be permitted if they are no closer than seventy-five feet (75') to the property line and can be spaced at least one hundred fifty feet (150') from other existing driveways. Each driveway shall not exceed twenty-eight feet (28') in width excluding the radii thereof which shall be ten feet (10').
(b) In areas zoned commercial or industrial under the current Village zoning regulations, one driveway per lot shall be permitted. Additional driveways may be permitted if they are no closer than seventy-five feet (75') to the property line and can be spaced at least one hundred fifty feet (150') from other existing driveways. Each driveway shall be a minimum width of twenty feet (20') and a maximum of twenty-eight feet (28') in width excluding the radii thereof which shall be twenty- five feet (25').
(c) All driveways shall be located in accordance with generally accepted traffic engineering standards. The location shall take into consideration adequate horizontal and vertical sight distance and distance from other driveways or street intersections so as to minimize traffic congestion and safety hazards.
(d) All driveways shall be designed in such a fashion as to compliment and not interfere with the existing roadway drainage. Driveways on streets with no curb and gutter must match the edge of pavement elevation and must slope away from the edge of pavement at least four feet (4') at a minimum rate of 3/16" per foot. Driveways on streets with curb and gutter may drain to the street. The driveway, at the edge of pavement, shall be a minimum of 1" and a maximum of 2" above the edge of pavement elevation. (e) Where curbing is needed, the contractor will be required to cut and construct such a curb in accordance with Section 1228.07
.
(f) All driveways installed where an open ditch exists shall adhere to the following regulations:
(1) Property owners are required to construct driveways and to keep driveways and approaches in repair and in working condition along public roads.
(2) Driveways crossing roadside ditches represent a potential restriction to the property flow of water in the ditch.
(3) A right-of-way work permit issued by Codes Enforcement Officer is required to install a drive entrance along a Village street. Said permit and request forms shall be established and maintained by the Codes Enforcement Officer.
(4) Requests for driveways shall be made on the Right-of-Way Work Permit Form and shall be fully completed. Said Right-of-Way Work Permit Form shall be created and maintained by the Codes Enforcement Officer and made available at the office of the Fiscal Officer.
(5) Driveway locations shall be marked on the property by the owner or agent. Ditch enclosures shall be marked at both ends.
(6) OUPS - Ohio Utilities Protection Service shall be called prior to excavating for any work in the right-of-way. (800-362-2764).
(7) No construction shall begin until the right-of-way work permit is issued.
(8) Driveways and drive pipes shall be installed in accordance with the requirements of the Codes Enforcement Officer and with the approved right-of-way work permit.
(9) If a property owner does not properly install or keep driveways and approaches in repair and in working condition, following written notification, the repair may be undertaken by Village forces. The cost so incurred by the Village may be assessed to the property owner.
(10) State highway permits are issued by the Ohio Department of Transportation. County road permits are issued by the counties. Township road permits are issued by the townships.
(11) Construction requirements are shown on the Village of Loudonville Right- of-Way Construction Detail Sheet.
(12) Current 55 mph speed limits require 750' of site distance for a safe drive entrance.
(13) The cutting of pavement is not permitted except when specifically authorized by granting authority.
(14) The permit holder’s contractors shall abide by the regulations for safety as detailed in the Manual of Uniform Traffic Control Devices and all OSHA standards.
(15) No untreated effluent will be permitted to drain into the right-of-way.
