(a) No person, firm or corporation shall establish or permit to be established or maintain or permit to be maintained any connection where by a private, auxiliary or emergency water supply, other than the regular public water supply of the Village of Loudonville, may enter the supply or distributing system of the Village of Loudonville, unless such private, auxiliary or emergency water supply and the method of connection and the use of such supply shall have been approved by the Superintendent of Water or by the Environmental Protection Agency.
(b) An approved backflow preventer shall be installed on each service line to a consumer’s water system serving the premises, where in the judgment of the Superintendent of Water, actual or potential hazards to the regular public water supply exist.
(c) An approved backflow preventer shall be installed on each service line to a consumer’s water system serving the premises where the following conditions exist:
(1) Premises having an auxiliary water supply, unless such auxiliary water supply is accepted as an additional source by the Superintendent of Water and is approved by the Ohio Environmental Protection Agency.
(2) Premises on which any substance is handled in such a fashion as to create an actual or potential hazard to the public water supply. This shall include premises having sources or systems containing process fluids or waters originating from public water systems which are no longer under the sanitary control of the Superintendent of Water.
(3) Premises having internal cross-connections that, in the judgment of the Superintendent of Water, are not correctable or intricate plumbing arrangements which make it impractical to determine whether or not cross- connections exist.
(4) Premises where, because of security requirements or other prohibitions or restrictions, it is impossible or impractical to make a complete cross- connection survey.
(5) Premises having a repeated history of cross-connections being established or re-established.
(6) Others as specified by the Superintendent of Water.
(d) An approved backflow preventer shall be installed on each service line to a consumer’s water system serving, but not necessarily limited to, the following types of facilities/uses, unless the Superintendent of Water determines no actual or potential hazard to the regular public water system exists:
(1) Hospitals, mortuaries, clinics, nursing homes;
(2) Laboratories;
(3) Sewage treatment plants, sewage pumping station or storm water pumping station;
(4) Food or beverage processing plants;
(5) Chemical plants;
(6) Metal plating industries;
(7) Petroleum processing or storage plants;
(8) Radioactive material processing plants or nuclear reactors;
(9) Car Wash;
(10) Restaurants and mobile food units;
(11) All other commercial, industrial and residential occupancies where specifically deemed necessary by the Superintendent of Water;
(12) Others as specified by the Superintendent of Water.
(e) An approved backflow preventer shall be installed at any point of connection between the regular public water system and an auxiliary water supply, unless such source is accepted as an additional source by the Superintendent of Water and the source is approved by the Ohio Environmental Protection Agency.
(f) As this section applies to mobile food units, each mobile food unit shall have an ASSE 1024 double check unit, or another unit approved by the Superintendent of Water and as specified under the regulations prepared by the Superintendent of Water.
(g) Backflow preventers required by these rules and regulations shall be installed at a location and in a manner approved by the Superintendent of Water and shall be installed by and at the expense of the water consumer.
Backflow preventers installed on the service line to a consumer’s water system shall be located on the consumer’s side of the water meter, as close to the meter as is reasonably practical, and prior to any other connection.
Backflow preventers for the Fair, downtown festivals and other activities where mobile food units are involved shall be made available by the Superintendent of Water, installed by the Superintendent of Water and at an expense to the consumer determined by the Board of Public Affairs.
(h) It shall be the duty of the Codes Enforcement Officer to cause inspections and investigations to be made of industrial and other properties served by the public water system where actual or potential hazards to the public system may exist. Such inspections and investigations shall be repeated as often as the Codes Enforcement Officer deems necessary.
(i) The Superintendent of Water, Codes Enforcement Officer or their duly authorized representative shall have the right to enter any property, unit or location served by the regular public water supply at any reasonable time for the purpose of inspecting the piping system or system thereof. On demand, the owner, lessee, or occupants of any property served shall furnish to the Superintendent of Water and/or Codes Enforcement Officer any information which he she may request regarding the piping system or systems or water used on such property. The refusal of such information shall be evidence of the presence of improper connections as provided in this section.
(j) The Superintendent of Water, if he/she and/or the Codes Enforcement Officer, determines, with the exception of mobile food units, that a backflow preventer device is necessary for the safety of the regular public water system, shall give notice to the consumer to install such an approved device within thirty (30) days of the notification.
With regard to mobile food units, the Superintendent of Water and/or the Codes Enforcement Officer shall, if he/she determines that a backflow preventer is required as outlined herein, notify said owner, lessee or operator thereof and require the same to be installed prior to any connection to the regular public water system.
(k) The water consumer and/or the owner of such property that has or is required to have a backflow prevention device shall have such backflow prevention device tested annually by a licensed backflow device inspector, the Superintendent of Water and/or the Codes Enforcement Officer at the consumer’s and/or owner’s expense. It shall be the responsibility of the owner and/or water consumer to provide a certified copy of each inspection to the Codes Enforcement Officer. Any backflow prevention device that fails the criteria for such test shall be repaired and/or replaced and a new inspection performed.
(l) The Superintendent of Water is hereby authorized and directed to discontinue, after reasonable notice to the water consumer, owner or occupant thereof, the water service to any property wherein any connection in violation of the provisions of this section is known to exist, and take such other precautionary measures he/she deems necessary to eliminate any danger of contamination of the regular public water supply. Water service shall not be restored until such conditions have been eliminated or corrected in compliance with the provisions of this section.
(m) Any property owner and/or water consumer that fails to comply with the requirements of this section is guilty of a minor misdemeanor. Each successive day that a consumer violates this section shall be deemed a separate offense.
