660.10 SIDEWALK OBSTRUCTIONS; DAMAGE OR INJURY.
   (a)   No person shall place or knowingly drop upon any part of a sidewalk or playground any tacks, bottles, wire, glass, nails or other articles which may damage property of another or injure any person or animal traveling along or upon such sidewalk or playground.
   (b)   No person shall walk on, or allow any animal upon, or injure or deface in any way, any soft or newly laid sidewalk pavement.
   (c)   Except as otherwise provided in paragraph (d) below, no person shall place, deposit or maintain any merchandise, goods, material, signs or equipment upon any sidewalk so as to obstruct pedestrian traffic thereon, except for such reasonable time as may be necessary for the delivery or pickup of such articles. In no case shall the obstruction remain on such sidewalk for more than one hour. The Retail Merchants Association of the Loudonville Chamber of Commerce may obtain a waiver of this regulation for special promotion days by requesting permission from Council.
   (d)   Merchants in the downtown area, in order to display their wares and attract business to their location, which are impermanent in nature and which are put on the sidewalks by the adjoining merchant and which are moved off the sidewalks at night, are permitted provided the merchant complies with the following:
      (1)   The merchant’s merchandise, goods, materials, signs or equipment must not obstruct pedestrian traffic by allowing at least a forty-eight inch clearance between the street and the display and/or must not have the merchandise, goods, materials, signs or equipment more than three feet from the outermost front of the merchant’s building so that at least a forty-eight inch unobstructed passage way is left for pedestrians; and
      (2)   The merchant must carry sufficient liability insurance coverage, being at least one hundred fifty thousand dollars ($150,000) to insure against injury to pedestrians using the sidewalks; and
      (3)   The merchant shall provide proof of liability insurance coverage as required in subsection (d)(2) hereof on an annual basis to the Village by and through the Codes Enforcement Officer.
   (e)   No person shall unload upon, or transport any heavy merchandise, goods, material or equipment over or across any sidewalk or curb without first placing some sufficient protection over the pavement to protect against damage or injury.
   (f)   No person shall allow any cellar or trap door, coal chute or elevator or lift opening in any sidewalk to remain open without providing suitable safeguards to protect and warn pedestrian traffic of the dangerous conditions.
   (g)   Whoever violates any of the provisions of this section is guilty of a minor misdemeanor. A separate offense shall be deemed committed each day during or on which a violation occurs or continues. Punishment shall be as provided in Section 698.02.
