(A) Each of the national codes adopted herein provides for a separate appeals board. However, the intent and requirements for an appeals board may be met with the creation by the local jurisdiction of a single appeals board for the entire State Building Code pursuant to W. Va. Code § 87-4-7.
(B) Any person aggrieved by any action or decision pursuant to § 150.23 of this chapter or the relevant penalties in § 150.99 of this chapter may appeal to the Board of Appeals within 30 days from the date of the action or decision in question. The fee to appeal said decision under § 150.23 is $500.
(C) The Board of Appeals shall consist of five members, with up to three alternates, who are qualified by experience and training to pass on matters pertaining to building construction and are not employees of the jurisdiction. They may include, but are not limited to, a state-registered professional architect or engineer or a state-licensed general building, residential, electrical, piping, plumbing, mechanical or fire protection contractor with at least ten years of experience, five of which shall be in responsible charge of work.
