§ 91.49 VEHICLES ON PRIVATE PROPERTY.
   (A)   Prior to any removal of any permitted or junked motor vehicle from private property only by the enforcement agency as permitted pursuant to W. Va. Code §§ 17-24A-1 et seq., as amended, and further, prior to the issuance of any citation authorized to be issued pursuant to the provisions of this subchapter, there shall first be given to the private property owner or other possessor of the private property who is not the owner, such as the lessee, and the owner of the motor vehicle, if ascertainable, a 30-day written warning notice either:
      (1)   Sent by registered or certified mail; or
      (2)   Served personally by the Town Inspector, Code Enforcement Officer or a police officer.
   (B)   Said notice shall provide that the removal action will be taken and a citation issued unless the motor vehicle is otherwise brought into compliance by proper removal, or being moved within an enclosed building, or otherwise being brought into compliance. All 30-day warning notices shall be prepared by the Town Inspector, Code Enforcement Officer or a police officer, and the form warning notice shall be filed with and approved by the Town Council.
   (C)   The 30-day warning notice period shall be deemed to commence with either the receipt date or service date of the warning notice.
