No fixed term franchises, permits or privileges for the construction or operation of elevated railways or subways shall be granted for a period exceeding forty (40) years for the original franchise, or for a period exceeding ten (10) years for a franchise about to expire, all in accordance with the provisions of Paragraph (d), Subsection 8, Section 3 of the Charter.
