Sec. 5.512. Creation and Administration of the Fund.
 
   (a)   There is hereby created and established in the Treasury of the City of Los Angeles a special trust fund to be known as the “Health Alternatives to Smoking Trust Fund”, hereinafter referred to in this chapter as the “Fund”.
 
   (b)   The purpose of the Fund shall be for the receipt, retention and disbursement of monies from the National Tobacco Settlement. Disbursements shall be made through Proposition K: LA for Kids Program Request for Proposal (RFP). Monies from the Fund may only be used for the acquisition of park land and recreation improvements in under-served areas. For purposes of this section, under-served areas are census tracts that meet all of the following criteria based on the latest available census:
 
   (1)   Above average youth in poverty (greater than 36%);
 
   (2)   Above average persons 18 and under (greater than 26%);
 
   (3)   Below average acreage in parks (less than 2%); and
 
   (4)   Not adjacent to major parks or national forest land.
 
   (c)   The Fund shall be administered by the Director of the Office of Administrative and Research Services or the successor thereto.
 
   (d)   All interest and other earnings attributable to monies in the Fund shall be credited to the Fund and shall be devoted to the purposes thereof.
 
   (e)   The Director of the Office of Administrative and Research Services, or the successor thereto, shall report to the Council and the Mayor regarding the Fund on an annual basis within 90 days after the close of the City’s fiscal year. Such report shall identify all expenditures out of the Fund, including the purposes for which the expenditures were made.
