(A) The Fire Chief and the Fire Prevention Bureau shall review written requests for modifications and variances to any regulations of the City of Lorain Fire Code.
(B) In cases of topographical condition, borderline situations and exceptional circumstances, the Fire Chief shall have the power to vary or modify any strict application to relieve such difficulty or hardship, providing that such variance, modification or interpretation shall remain in harmony with the general purposes and intent of such Code, so that the health, safety and general welfare of the City shall be secured and justice done.
(C) Appeals: Whenever the Fire Chief disapproves an application or refuses to grant a permit applied for, or when it is claimed that the provisions of the Ohio Fire Code do not apply or that the true intent and meaning of the Code have been misconstrued or wrongly interpreted, the applicant may appeal from the decision of the Fire Chief to the Ohio Department of Commerce, Division of State Fire Marshal within thirty (30) days from the date of the decision being appealed.
