634.01 PROHIBITED NOISES AND DISORDERLY ACTS GENERALLY.
   (a)   No person shall make, continue or cause to be made, by the use of any horn, bell, radio, television or loudspeaker, or by the operation of any instrument or device, or in any other manner produce, an unreasonably loud, disturbing and unnecessary noise of such character, intensity and duration as to disturb the peace and quiet of the community or be detrimental to the life, health, repose, peace or safety of any individual within the limits of the City. No person shall willfully conduct himself or herself in a noisy, boisterous or other disorderly manner, by either words or acts, which so disturb the good order and quiet of the community.
   (b)   Whoever violates this section is guilty of a misdemeanor of the fourth degree. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.

634.02 ADVERTISING BY THE USE OF BELLS, HORNS, WHISTLES, ETC.
   (a)   The use of bells, horns, whistles, loudspeakers, musical devices or other sound-producing devices to advertise or call attention to the offering for sale of merchandise or services, or for other commercial purposes, is hereby prohibited, provided that this prohibition shall not extend to the use of such devices within an enclosed building if the sound emanating therefrom is not so loud as to disturb the peace and quiet of persons outside such building.
   (b)   Whoever violates this section is guilty of a minor misdemeanor for a first offense. For a second offense occurring within one year of the first offense, such person is guilty of a misdemeanor of the fourth degree. For a third offense occurring within one year of the first offense, such person is guilty of a misdemeanor of the third degree. For a fourth or subsequent offense occurring within one year of the first offense, such person is guilty of a misdemeanor of the first degree. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.

634.03 OUTDOOR CONCERTS.
   (a)   No owner or sponsor of an outdoor concert, or other person, shall fail or refuse to lower or reduce the level, intensity or power of any loudspeaker or any other device or equipment designed to amplify or enhance the sound from an outdoor concert when directed to do so by the Safety-Service Director or his or her designee (i.e. the Chief of Police or Deputy Chief).
   (b)   Whoever violates this section is guilty of a misdemeanor of the fourth degree. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.

634.04 MUSICAL INSTRUMENTS, RADIOS, ETC.
   (a)   No person shall operate or permit to be operated any musical instrument, radio, phonograph, television set or any other instrument or device capable of producing noise, in such a manner or with such volume as to create unnecessary, excessive or offensive noise which annoys or disturbs the peace, quiet, comfort or repose of the neighboring inhabitants, between the hours of 10:00 p.m. and 7:00 a.m. of the following day.
   (b)   Whoever violates this section is guilty of a misdemeanor of the fourth degree. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.

634.05 SWIMMING POOLS.
   (a)   No person shall make, continue or cause to be made or continued, in any swimming pool, unnecessary, excessive or offensive noise which annoys, disturbs, injures or endangers the comfort, repose, health, peace or safety of others, particularly between the hours of 10:00 p.m. and 7:00 a.m. of the following day.
   (b)   Whoever violates this section is guilty of a misdemeanor of the fourth degree. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.

634.06 ANIMALS.
   (a)   No owner, keeper or harborer of any animal shall permit or suffer such animal to continuously or frequently bark, howl or omit other audible sounds which create unreasonable, excessive or offensive noise to the annoyance or discomfort of any person of ordinary sensibilities in the vicinity of such animal.
   (b)   Whoever violates this section is guilty of a misdemeanor of the fourth degree. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.

634.07 NOISE IN THE VICINITY OF SCHOOLS, HOSPITALS AND CHURCHES.
   (a)   No person shall create any unnecessary, excessive or offensive noise on any street, sidewalk or property adjacent to any school, institution of learning or church while any of the same is in use, or adjacent to any hospital at any time, provided that conspicuous signs are displayed on or near such street, sidewalk or public place indicating the presence of a school, institution of learning, church or hospital.
   (b)   Whoever violates this section is guilty of a misdemeanor of the fourth degree. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.
