(a) Whoever violates any of the provisions of Section 1046.23(a) shall be liable for a civil penalty of not more than five hundred dollars ($500.00) for each day on which a violation occurs and shall be liable for damages caused by such violation.
(b) Whoever violates Section 1046.23(b) is guilty of a misdemeanor of the first degree and shall be fined not more than one thousand dollars ($1,000) or imprisoned not more than six months, or both.
