Anyone who causes damage or destruction to a tree on city property, without a proper permit, shall compensate the city for such damages. The damages shall be determined by the city forester using the methodology of the International Society of Arboricultural/Council of Landscape Appraisers. If malicious intent can be shown, then treble damages shall be assessed. The city attorney may take whatever action is necessary in a court of competent jurisdiction to collect such damages as are not voluntarily paid after assessment.
