§ 157.163 SHORT TERM RENTALS.
   (A)   Purpose. The purpose of this section is to promote public health, safety, and welfare by establishing standards relating to the location and operation of short term rentals.
   (B)   Intent. It is the policy of the City of Logan to permit short term rentals within specified zoning districts with standards to regulate their location and prevent a concentration from forming which may have a negative impact on surrounding neighborhoods and the city.
   (C)   Applicability. The regulations contained within this section shall only apply to short term rentals as defined in division (D) below and shall not apply to a hotel or motel as defined in the City of Logan Zoning Code, Ohio Revised Code, or Ohio Building Code.
   (D)   Definition. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      SHORT TERM RENTAL. Any dwelling which is rented wholly or partly in exchange for a compensatory fee for a period of time less than 30 consecutive days in any 12 month period.
   (E)   Where permitted. Short term rentals shall be permitted in the following zoning districts and subject to the regulations within this section.
      (1)   R-2 Zoning District;
      (2)   R-2-B Zoning District;
      (3)   B-1 Zoning District;
      (4)   B-2 Zoning District;
      (5)   M-1 Zoning District; and
      (6)   M-2 Zoning District.
   (F)   Location.
      (1)   Short term rentals shall not be permitted within:
         (a)   500 feet from the boundary of any property that contains a school or educational use, which may include public or private schools, daycare facilities, parochial schools, or secondary education;
         (b)   500 feet of a short term rental or tourist home in the R-2 District; or
         (c)   300 feet of a short term rental or tourist home in the R-2-B, B-2, M-1, and M-2 Districts.
      (2)   The location requirements in divisions (F)(1)(b) and (F)(1)(c) shall apply to short term rental units located in separate buildings.
      (3)   Short term rentals located in the B-1 District are exempt from the requirements of division (F)(1) above.
   (G)   Ownership. Any short term rental must:
      (1)   Be located within 25 miles of the owner's principal residence;
      (2)   If the owner does not reside within 25 miles of the city, be controlled by a property agent, manager, or caretaker residing within 25 miles of the city who is designated in the rental dwelling license application by name, address, and telephone number, and who may receive service of any and all notices required or allowed;
      (3)   No person, business, or entity shall own or operate more than three short term rentals in the R-2 or R-2-B Districts.
   (H)   Licensing.
      (1)   Short term rental unit owners shall submit for and obtain an approved short term rental license before commencing operations. The application for a short term rental license shall:
         (a)   Contain all documents required by the City of Logan;
         (b)   Include a plan for the proposed site showing the locations of all buildings and the location of required off-street parking spaces; and
         (c)   The application fee shall be $50, and the annual license fee shall be $500. The annual fee shall be due upon issuance of the short term rental license, and each successive year at the time the Service Director directs.
      (2)   Any short term rental application for a property located near a school property or in the R-2, R-2-B, or B-2 District shall submit a list of all addresses within 300 or 500 feet of the property from the Hocking County Auditor's Office to demonstrate compliance with the requirements of division (F) above.
      (3)   As part of the short term rental application, the applicant shall either:
         (a)   Provide a vendor's license from the State of Ohio; or
         (b)   Provide an affidavit that the applicant has less than five short term rentals in the State of Ohio.
      (4)   One short term rental application form is required for each short term dwelling unit (e.g., each unit of a duplex or triplex shall be considered a separate unit requiring an individual application.)
      (5)   The application for a short term rental license shall be submitted to the Service Director. It shall contain all the specified documents and shall demonstrate that all standards and requirements for a short term rental unit have been met.
      (6)   An applicant will be required to obtain a certificate of occupancy from the State of Ohio within one year of submitting an application to the city for a short term rental license. The Service Director shall make the final decision as to whether a city certificate of occupancy will be granted and whether a short term rental license will be issued.
      (7)   First time short term rental license applications may be submitted to the City of Logan Service Director at any time. Renewal applications shall be submitted between October 1 and December 1 and include the required application fee.
      (8)   No more than 60 short term rental licenses shall be approved and active at any one time in the R-2 or R-2-B Districts.
      (9)   The short term rental license shall be posted in a conspicuous place in the portion of the dwelling unit accessible to the renter.
      (10)   Short term rental license holders are subject to the same lodging tax that hotel owners pay on their room rates.
   (I)   Occupancy. No more than ten guests may occupy a short term rental at any given time.
   (J)   Accessory uses. The renting of individual accessory uses or structures such as swimming pools, tennis courts, basketball courts, pickleball courts, or other such recreational areas without renting or leasing the principal dwelling unit or units on a subject property is prohibited.
   (K)   Parking. Short term rentals units shall have at a minimum one off-street parking space for each bedroom. Short term rentals located in the B-1 District are exempt from this regulation.
   (L)   Ingress/egress. No new access points, driveways, or curb cuts shall be created or installed for access to the short term rental unit.
   (M)   Signage. Short term rental units shall be permitted one informational wall sign in compliance with the City of Logan sign ordinances containing the address and may contain the name, if any, of the short term rental unit. No outdoor advertising on the property is permitted.
   (N)   Reporting. Income from a short term rental unit must be reported annually to the City of Logan Income Tax Department.
   (O)   Nuisances. Short term rental units shall not generate noise, trash, glare, obstructions, odors, vibrations, or other effects that unreasonably interfere with any individual's use and enjoyment of his/her property.
   (P)   Revocation of license. The City of Logan shall have the authority to revoke a short term rental license for any infraction of this section or for violations of the City of Logan Code of Ordinances or regulations of the Hocking County Health Department.
