§ 153.08 CERTIFICATE OF OCCUPANCY.
   (A)   General provisions. A responsible person shall maintain a copy of the current certificate of occupancy for a structure regulated by the building code in accordance with Rule 1301:7-7-80 of the Administrative Code and make it available to the Chief Code Official or his or her designee upon request. This division only applies to a certificate of occupancy in existence as of the effective date of this rule issued by a building official and/or a certificate of occupancy issued by a building official after the effective date of this rule.
   (B)   Change of use or occupancy. Changes shall not be made in the use or occupancy of any structure that would place the structure in a different division of the same group or occupancy or in a different group of occupancies, unless such structure is made to comply with the requirements of this code and the building code as listed in Rule 1301:7-7-80 of the Administrative Code. Subject to the approval of the Chief Code Official or his or her designee, the use or occupancy of an existing structure shall be allowed be changed and the structure is allowed to be occupied for purposes in other groups without conforming to all the requirements of this code and the building code as listed in Rule 1301:7-7-80 of the Administrative Code for those groups, provided the new or proposed use is less hazardous, based on life and fire risk, than the existing use.
