§ 157.298 VARIANCES TO SPACING REQUIREMENTS.
   As a part of an application for a conditional use permit the applicant may request a variance from the spacing requirement required by § 157.297(J). The Board of Zoning Appeals may grant such a variance as a part of the application for a conditional use permit it the applicant proves, beyond a reasonable doubt that:
   (A)   The proposed location has unique advantages for the education or rehabilitation of the facility's residents including:
      (1)   Proximity to other social service organizations, government agencies, businesses or institutions which will provide services or employment opportunities to residents.
      (2)   Convenient access by public or private transportation to social service organizations, government agencies, businesses or institutions which will provide services or employment opportunities to residents.
   (B)   The average family size of all existing and proposed Category A, B, C, and D facilities within the census tract of the proposed facility does not exceed the average family size of the census tract as shown by the most recent federal decennial census.
   (C)   That the proposed facility at the proposed location will not alter the residential nature of any residential neighborhood create an institutional setting or a de facto social service district, and will not exceed existing community recreational or social service resources.
