§ 157.294 DEFINITION OF COMMUNITY BASED RESIDENTIAL SOCIAL SERVICE FACILITIES.
   COMMUNITY-BASED RESIDENTIAL SOCIAL SERVICE FACILITY. A facility which:
   (1)   Provides supervised room, board, accommodations, personal care, and similar services in a residential setting to any unrelated persons who live together in such a setting as a single housekeeping unit and whose disabilities or status limit their ability to live independently, and only secondarily for training, rehabilitation, and for clinical services.
   (2)   Is:
      (a)   A facility certified by the Ohio Department of Health as an alcoholism program under R.C. Chapter 3720 as an intermediate supportive recovery facility as defined in Chapter 3701-55 of the Ohio Administrative Code and meets the requirements of Chapter 3701-57 of the Ohio Administrative Code.
      (b)   An adult foster care facility as defined and licensed by the Ohio Department of Human Services pursuant to R.C. §§ 5103.30 - 5012.34 and that meets the requirements of Chapter 5101.2-19 of the Ohio Administrative Code.
      (c)   A residential care facility for mentally ill persons as defined in R.C. § 5119.22 and licensed by the Ohio Department of Mental Health pursuant to the provisions of Chapter 5122.3-5 of the Ohio Administrative Code.
      (d)   A short term non-methadone drug treatment residential facility certified by the Ohio Department of Mental Health and defined as a halfway house by § 5122.3-9-22 of the Ohio Administrative Code.
      (e)   A residential facility for persons with developmental disabilities as defined in R.C. § 5123.19(A)(1) and licensed by the Ohio Department of Mental Retardation and Developmental Disabilities pursuant to Chapter 5123.2-3 of the Ohio Administrative Code.
      (f)   A residential facility or foster home for adjudged delinquents, status offenders, or unruly youth licensed, certified or approved by the Ohio Department of Youth Services pursuant to R.C. Chapter 4139 and meeting the requirements for agency group homes under Chapter 5139-11 of the Ohio Administrative Code or meeting the requirements for foster homes under Chapter 5139-23 of the Ohio Administrative Code.
      (g)   A community residential facility or halfway house for adult offenders, parolees, probationers and furloughees licensed by the Adult Parole Authority pursuant to R.C. § 2967.14(C) and meeting the requirements of Chapter 5120.1-3 of the Ohio Administrative Code.
      (h)   A residential facility providing care for children or adolescents in the custody of a county human services department, county children services board or a private agency certified under R.C. § 5103.03. Such facilities include any boarding home, foster home, or group home as defined in Chapter 5101.2-3 of the Ohio Administrative Code and any facility licensed, approved or certified pursuant to Administrative rules of the Ohio Department of Human Services pursuant to Chapters 5101.2-5, 5101.2-7, 5101.2-9, or 5101.2-11 of the Ohio Administrative Code.
