§ 157.088 DAMAGED NON-CONFORMING BUILDINGS AND STRUCTURES.
   Any non-conforming structure that is damaged by more than 60 percent of its current fair market value at the time of damage may not be reconstructed and used as before the damage occurred. In such instances new construction shall conform with all dimensional requirements and only uses permitted or conditionally permitted under this chapter shall be allowed. If the damage is 60 percent or less of its current fair market value, it may be reconstructed to conform with previous dimensional characteristics and the previous use may be permitted if such reconstruction begins within 90 days from the date of damage. The Board of Zoning Appeals shall review data submitted by an owner to determine if the damage is actually less than 60 percent of current fair market value and shall utilize the most recent Hocking County tax duplicate in making said determination. The 90 day provision may be extended by the Board of Zoning Appeals only where evidence is submitted that the applicant is awaiting an insurance settlement. In the case of a damaged structure, the owner shall have debris removed within 30 days.
