§ 90.99 PENALTY.
   (A)   Except as otherwise provided in this chapter, any person who violates this chapter shall be deemed guilty of a misdemeanor of the fourth degree.
   (B)   If, within 18 months of the offense, the offender previously has been convicted of or pleaded guilty to a misdemeanor of the fourth degree, whoever violates this section is guilty of a misdemeanor of the third degree.
   (C)   If, within 18 months of the offense, the offender previously has been convicted of or pleaded guilty to a misdemeanor of the third degree, whoever violates this section is guilty of a misdemeanor of the second degree.
   (D)   If, within 18 months of the offense, the offender previously has been convicted of or pleaded guilty to a misdemeanor of the second degree, whoever violates this section is guilty of a misdemeanor of the first degree.
