11-1-3: DEFINITIONS:
In this chapter, the word "building" shall mean and be interchangeable with the word "structure". The word "used" shall be included and be interchangeable with "arranged", "designed", "constructed", "altered", "converted", "rented", "leased", or "intended to be used". The definitions set out below shall govern the interpretation of the words to which they are attached.
ACCESSORY BUILDING: A building or structure customarily incidental and subordinate to the main building and located on the same lot with the main or principal building.
ACCESSORY USE: A use customarily incidental, appropriate, and subordinate to the principal use of the land or buildings located on the same lot or premises.
BOARD OF TRUSTEES: The Board of Trustees of the Town, and necessarily includes and is interchangeable with the "Town", "Town Board of Trustees" and "Governing Body".
BUILDING: Any structure intended for shelter, housing, or the enclosure of persons, animals, or chattels. When separated by dividing walls without openings, each portion of such structure so separated shall be deemed a separate building.
BUILDING, MAIN: A building in which is conducted the principal use of the lot on which it is situated. Any dwelling shall be deemed to be a main building on the lot on which it is situated.
DWELLING: Any building or portion thereof which is designed or used as living quarters for one or more persons.
LOT: Any plot of land occupied or intended to be occupied by one building or a group of buildings, and its accessory building and uses, including open spaces, and having its principal frontage on a street.
MOBILE HOME: Means and includes any vehicle or structure so designed and so constructed as to permit occupancy thereof as a temporary or permanent dwelling or sleeping place for one or more persons and originally designed or constructed to be placed on wheels and moved about by towing or otherwise, whether or not the wheels for such vehicle or structure have been put in place or removed, and shall include what is commonly called a trailer coach. Vehicles or equipment commonly known as campers or overnight campers, the sleeping quarters of which are being occupied, shall be included within the meaning of the term mobile home and governed by the provisions of this chapter. Such campers, which are not being occupied, shall be excepted from the meaning of such term for the purpose of this chapter.
MOBILE HOME LOT: A portion of a mobile home park allocated to the exclusive use of the occupants of a single mobile home.
MOBILE HOME PARK: Any site, lot, field or tract of ground upon which mobile homes are placed for occupancy, and shall include any building, structure, vehicle or enclosure used or intended for use as a part of the equipment of such park.
NONRESIDENTIAL: Any type of land use not classified as a residence or dwelling place of one or more persons, and includes commercial, industrial and all other types of land uses.
PLANNING COMMISSION OR COMMISSION: The Planning Commission of the Town, and necessarily includes and is interchangeable with "commission", or "Zoning Commission".
RESIDENCE OR RESIDENTIAL: Any building, structure, or portion thereof, which is designated or used as living quarters for one or more persons, but not including a tent, cabin, trailer coach, boarding or rooming house, hotel or motel, apartment, duplex, or multiple dwelling.
STREET: Any public or private thoroughfare which affords the principal means of access to abutting property.
STRUCTURAL ALTERATIONS: Any change in the supporting members of a building, such as the bearing walls or partitions, columns, beams or girders, or any substantial change in the roof or the exterior walls.
STRUCTURE: Anything constructed or erected, the use of which requires permanent location on the ground, or attachment to something having a permanent location on the ground. (2014 Code § 12-204)
