9-2-3: CONTAINER REQUIREMENTS:
   A.   Container Required: It is the duty of every person, firm, or corporation owning, managing, operating, leasing or renting any premises or any place where garbage or rubbish accumulates to provide, and at all times to maintain in good order and repair, on any premises, a portable container or containers for refuse. Said container or containers shall be provided by the collection service.
   B.   Specifications:
      1.   Each container shall be rodentproof and flyproof, with a tight fitting lid which shall not be removed except when depositing or removing the contents of the receptacle, and with handles on the sides and of sufficient capacity and in sufficient numbers to accommodate and securely keep all the garbage and rubbish that may accumulate between collections.
      2.   Each container shall have a capacity of not more than thirty two (32) gallons, except where approved type bulk storage containers are in use.
      3.   All residential trash must be bagged where possible and placed inside the trash container with lids closed at all times.
      4.   Only trash contained in the trash containers provided by the service provider will be collected unless special arrangements have been made.
      5.   All commercial trash must be bagged where possible and placed inside the trash container with lids closed at all times.
      6.   All trash containers provided for bulky waste disposal must be covered and secured to prevent trash from blowing and littering surrounding properties.
   C.   Maintenance Requirements:
      1.   All containers shall be kept clean and free from the accumulation of any substance remaining attached to the inside of the container which would attract flies, mosquitoes and any other insects.
      2.   All containers and grounds immediately around same shall be kept in a safe and sanitary condition at all times.
      3.   In the event of vandalism and/or theft, a police report must be filed and copies provided to the Public Works Authority prior to replacement of the trash container.
      4.   In the event of destruction through negligence (deliberate or inadvertent), the owner/occupant shall be responsible for replacement costs of the trash container.
   D.   Location For Collection:
      1.   All containers shall be kept in a convenient location for collection, as designated by the Town Board of Trustees, whereby collectors can obtain same without going into buildings, garages, locked gates or fenced yards with dogs.
      2.   Residential trash containers must be placed within three feet (3') of the roadside by seven o'clock (7:00) A.M. on collection day and removed as soon as possible after collection.
      3.   The designated collection site for commercial trash containers must be clear of obstructions to accommodate standard collection vehicles by six o'clock (6:00) A.M. on collection days.
   E.   Trash Collection:
      1.   Residential customers must have their trash containers out to the street by seven o'clock (7:00) A.M. on collection day and removed as soon as possible.
      2.   Commercial customers must have their designated collection site cleared of obstructions to accommodate standard collection vehicles by six o'clock (6:00) A.M. on collection days.
      3.   Bulky waste disposal collection will be coordinated directly with the service provider.
      4.   Only trash contained in the trash containers provided by the service provider will be collection unless previous arrangements have been made with the service provider. (2014 Code § 17-202; amd. 2018 Code)
