§ 50.05 NEW CONSTRUCTION AND PROPOSED EXTENSIONS OF SEWER SYSTEM.
   (A)   Any developer or owner who desires to construct a building or buildings to be served by the city sewer collection system must:
      (1)   Accept the city's conditions for design, construction and acceptance of sewer lines; and
      (2)   Request a letter of intent from the city to serve the proposed project.
   (B)   Upon receipt of a letter of intent from city, the proposed sewer connection design plans and specifications shall be completed in accordance with city conditions and must be provided to the Director of Public Works for review and approval.
   (C)   (1)   Upon approval of the design by the Director of Public Works, the developer or owner applicant shall:
         (a)   Pay an allocation fee in an amount to be set periodically by City Council;
         (b)   Submit a permit application; and
         (c)   Pay an application fee of $300.
      (2)   Upon receipt by city of the application and assessed fees, a flow allocation and acceptance letter from the city shall be issued.
   (D)   The city in its discretion, as a condition of approving any new development or construction, may require improvements, connections or upgrades to the sewer system, to be completed at the city's direction and billed to the developer or owner. In such cases, city shall enter into a written development agreement with the developer or owner, and shall require the developer or owner to deposit an estimated amount of improvement costs with the city, prior to the commencement of construction of sewer improvements.
   (E)   Tap fees for new construction on single lots served by the city sewer system are due at the issuance of a zoning compliance permit. An application fee of $300 per lot is also due at the time of the permit application.
