(A) This section aims to regulate noise in Locust Town Center to ensure a harmonious evironment for both residential and commercial occupants. It specifically addresses the control of music, amplified sound, and other noise sources to maintain an acceptable noise level that respects the comfort and well being of residents.
(B) Under the 2014 Land Use Plan, Locust Town Center is recognized as a mixed-use community encompassing residential, commercial, and recreational properties. The noise regulations herein apply to all properties within this designated area.
(C) The maximum allowable noise levels in Locust Town Center shall be:
(1) 80 db(A) Sunday through Thursday between 8:00 a.m. and 10:00 p.m.;
(2) 60 db(A) Sunday through Thursday between 10:00 p.m. and 8:00 a.m. the following day;
(3) 80 db(A) Friday and Saturday between 8:00 a.m. and 11:00 p.m.;
(4) 60 db(A) Friday and Saturday between 11:00 p.m. and 8:00 a.m. the following day.
(D) For measurement of decibel limits prescribed in this section, measurement shall be taken at or beyond the property line of residential property, excluding mixed-use buildings, of the party that initiated the complaint (complainant). For purposes of measurement, the back of the curb, the outside edges of driveways, fences, hedges or other physical features commonly associated with property boundaries are presumed to be at a point which is at or beyond the property line.
