(A) The City of Lockport hereby adopts and incorporates the provisions of the Food Handling Regulation Enforcement Act (410 ILCS 625/1 et seq.), as amended.
(B) Home kitchen operations as defined by Food Handling Regulation Enforcement Act, as amended, are permitted to operate within the City of Lockport. Upon the required registration with the City of Lockport, the sale of non-potentially hazardous baked goods as defined by § 3.6 of the Act (410 ILCS 625/3.6) by home kitchen operations is also permitted in accordance with the Food Handling Regulation Enforcement Act.
(C) The City of Lockport hereby authorizes the direct sale of baked goods as described in Section 4 of the Food Handling Regulation Enforcement Act with required registration of the home kitchen operation with the City of Lockport and in compliance with § 156.035 of the City's Code of Ordinances regarding home occupations except that § 156.035(B)(3) limitation prohibiting manufacturing or processing of any sort will not apply to home kitchen operations.
(D) The registration requirement of the home kitchen operation shall not be construed in any manner as an approval by the city, its employee or agents, of the safety or non-hazardous contents or conditions of the baked goods sold by the home kitchen operations.
