§ 110.23 OPERATORS OF VIDEO GAMING TERMINALS.
   (A)   VG operator license shall authorize the license holder to have and permit or allow the use of video gaming terminals in an establishment in the city.
   (B)   VG operator license shall be subject to the following conditions:
      (1)   The video gaming terminals shall be supplied by a duly licensed VG distributor under this subchapter;
      (2)   Number of video gaming terminals: No more than five video gaming terminals shall be issued to a liquor licensed establishment that holds a Class C (C-1 or C-2) liquor license. For all other licensed establishments including licensed truck stop and licensed large truck stop, no more than six video gaming terminals shall be issued and in operation in each establishment or licensed truck or large truck stop;
      (3)   Screening. For an establishment that holds a Class C (C-1 or C-2) liquor license, a floor plan that indicates the location of the video gaming terminals and the method of screening or a partition that sufficiently covers or blocks from view the video gaming terminals with a separate door or other gate for ingress and egress to the video gaming area must be submitted with the VG operator license application. Such plan must receive approval by the Mayor or the VG Commission as a condition of the license;
      (4)   Required signs. Required signage pursuant to state laws, regulations, and city ordinances shall be posted at all times in the establishment's video gaming terminal area and should further include signage prohibiting the video gaming terminal area to persons under 21 years of age;
      (5)   Advertisement. The location, size, and lighting of signs advertising or promoting video gaming or video gaming machines must be approved by the Mayor or the VG Commission prior to posting or to be allowed the continued posting. Factors to consider for the signs can include, but is not limited to, the establishment's visibility in a transitional or corridor area, the esthetic of the surrounding area, the protection of the integrity of the neighboring businesses, and/or objections from surrounding residence; and
      (6)   Inspection. All licensed video gaming establishments shall be subject to inspection of the premises by the city for compliance of this subchapter and all other applicable ordinances and state statutes.
