§ 110.21 VG LICENSE REQUIRED.
   (A)   Except as otherwise provided, it shall be unlawful for any person or entity:
      (1)   To have, keep for use, or permit to be used or placed any video gaming terminal without first obtaining a VG terminal operator license under this subchapter: or
      (2)   To distribute, sell, lease out, establish, supply, deliver, or place any video gaming terminal without first obtaining a VG distributor's license under this subchapter in any establishment within the city's corporate boundaries.
   (B)   License permit. Upon approval, the establishment or licensed truck stop or licensed large truck stop shall post in a conspicuous place for public view in the licensed premises at all times of operation, a VG distributor/VG terminal operator license with a license number, the name of the VG distributor, the name of the VG terminal operator, the number of VG terminals licensed for the establishment or licensed truck stop or licensed large truck stop, and the current license year, and the address of the establishment. Each VG terminal or machine shall be affixed with a video gaming tag bearing the notation: “City of Lockport VG gaming license for (current license year)” for the current license. No video gaming tag shall be issued for any video gaming terminal in which a VG distributor that shares a portion of the video gaming revenue for that terminal is not a licensed VG distributor under this subchapter.
   (C)   Any person or entity that distributes or operates a video gaming terminal pursuant to this section must have a license from the State of Illinois pursuant to ILCS Ch. 230, Act 40, §§ 1 et seq.
   (D)   Annual fee. The annual fees shall be due and payable on the first day of January of each year. All issued licenses under this subchapter shall expire on the 31 day of December of that year. These fees are not in lieu of any fee or payment payable to the state or the Illinois Gaming Board. There will be no prorating of the fee during the calendar year. Specifically, the annual fee for video gaming terminals or devices shall be for each video gaming terminal or device. The annual fee for a VG distributor license shall be for each licensed establishment which the licensee shares a portion of the video gaming revenue.
      (1)   VG Distributor License. An applicant for a VG distributor license shall, upon application and approval, pay a requisite annual license fee of $2,500 for each licensed establishment. Said license requirement for VG distributor and license fee shall be in effect commencing the 2020 license year.
      (2)   VG Operator License. Except for a licensed truck stop or licensed large truck stop establishment, an applicant for a VG operator license shall, upon application and approval, pay a requisite annual license fee of $100 per video gaming terminal or device. Said license requirement for VG operator and license fee shall be in effect commencing the 2020 license year.
      (3)   VG Operator License for licensed truck stop or large truck stop establishment. An applicant for a licensed truck stop or large truck stop establishment shall, upon application and approval, pay a requisite annual license fee of $500 per video gaming terminal or device.
   (E)   Term. A license issued under this subchapter shall be a purely personal privilege, good for not to exceed one year after issuance unless sooner revoked and shall not constitute property, nor shall it be subject to being encumbered or hypothecated. Such licenses shall not descend by the laws of testate or intestate devolution and shall be nontransferable.
