§ 37.02 METHODS OF DISPOSAL.
   (A)   When the City Council has determined that any personal property with a remaining value is no longer necessary or useful to the city, the property shall be declared surplus property by ordinance and may be disposed of in any of the following ways.
      (1)   Trade in for replacement item;
      (2)   Sale through competitive bidding at a public bid;
      (3)   Transfer to another governmental agency or not-for-profit organization;
      (4)   Contract sale through public bidding procedure;
      (5)   Other manner as authorized by the City Council.
   (B)   No elected official, appointed official, or employee in a supervisory capacity of the city shall be permitted to acquire any personal property owned by the city and declared to be surplus property under §§ 37.01 and 37.02. The prohibition on the acquisi-tion of surplus property shall extend to the family of each official and supervisory employee. The term FAMILY as used in this division (B) shall mean any person residing in the same household with the official or supervisory employee.
   (C)   The term SUPERVISORY EMPLOYEE includes any employee who has the authority to hire, fire, discipline or direct other employees such as department heads, foremen, police lieutenants and sergeants.
