§ 30.001 COMPOSITION OF CITY COUNCIL; EMERGENCY POWERS OF MAYOR.
   The City Council shall consist of the Mayor and Alderpersons.
   (A)   Mayor.
      (1)   The Mayor shall be chief executive officer of the city. He shall be a citizen of the United States, a qualified elector and reside within the city limits for at least one year next preceding his election or appointment.
      (2)   The Mayor shall sign all licenses issued by the city and any license so granted may be revoked upon written notice of the Mayor in such cases as are now or may hereafter be provided by the ordinances of the city and the laws of the state. The Mayor is ex officio member of all committees.
      (3)   Before entering upon the duties of his office, he or she shall be required to take and subscribe the oath for the faithful discharge of the duties of the Office of the Mayor.
   (B)   Emergency power of the Mayor.
      (1)   As used in this section, the following terms shall have the following meanings ascribed to them respectively:
         CURFEW. A prohibition against any person or persons walking, running, loitering, standing, or motoring upon any alley, street, highway, public property or vacant premises within the corporate limits of the city, except officials of any governmental unit and persons officially designated to duty with reference to a civil emergency.
         A STATE OF EMERGENCY.
         1.   A riot, unlawful assembly, mob action, or civil disturbance characterized by the use of actual force or violence or any threat of force or violence accompanied by apparent immediate power to execute such threat by person or persons in the city without authority of law.
         2.   Any natural disaster or man-made calamity, including flood, conflagration, cyclone, tornado, earthquake or explosion within the corporate limits of the city, resulting in the death or injury of persons or the destruction of property to such an extent that extraordinary measures must be taken to protect the public health, safety, and welfare.
      (2)   The Mayor is authorized, upon the occurrence of a state of emergency, to find that the state of emergency exists in accordance with the definitions of § 30.001(B)(1), and he is, in addition, authorized to exercise the powers granted in this section during the state of emergency, upon his signing under oath a statement finding that a state of emergency does exist. This statement shall also set forth facts to substantiate such findings, describe the nature of the emergency, and declare that a state of emergency exists.
      (3)   This statement shall be filed with the City Clerk as soon as practicable after its execution.
      (4)   After a declaration of a state of emergency by the Mayor, he may order a general curfew applicable to such persons and to such geographical areas of the city, or to the city as a whole, as he deems advisable, and the curfew shall be applicable during such hours of the day or night as he deems necessary in the interest of the public safety and welfare.
      (5)   After the declaration of a civil emergency, the Mayor may also in the interest of public safety and welfare make any or all of the following orders, by executive order:
         (a)   Order the closing of all retail liquor stores, including taverns and private clubs or portions thereof wherein the consumption or sale of intoxicating liquor and beer is permitted.
         (b)   Order the discontinuance of the sale of alcoholic liquor by any wholesaler or retailer.
         (c)   Order the discontinuance of selling, distributing, or giving away gasoline or other liquid flammable or combustible products in any container other than a gasoline tank properly affixed to a motor vehicle.
         (d)   Order the discontinuance of selling, distributing, dispensing, transferring, or giving away any firearms or ammunition of any character whatsoever.
         (e)   Issue such other orders as are imminently necessary for the protection of life and property.
      (6)   A statement of emergency declared by the Mayor in accordance with this section shall expire not later than the adjournment of the first regular meeting of the City Council after a state of emergency is declared by the Mayor.
      (7)   Upon issuing the declaration herein authorized, the Chief of Police shall notify the news media situated within the city and shall cause three copies of the declaration declaring the existence of the emergency to be posted at the following places within the city: the city hall, the police station and the post office.
      (8)   Any person violating the provision of this section or any executive order issued pursuant thereto shall be guilty of an offense and upon conviction thereof shall be fined not less than $25 nor more than $500.
   (C)   Alderpersons.
      (1)   There shall be two Alderpersons for each ward established by ordinance for the city.
      (2)   Each Alderperson shall be a citizen of the United States, a qualified elector of the munici-pality having resided therein at least one year next preceding his election or appointment, and reside in the ward in which he is elected or appointed. One Alderpersons from each ward shall be elected every two years. Each Alderperson elected shall hold his office for a term of four years and until his successor is elected and qualified. The Alderpersons shall attend all regular and special meetings of the City Council.
