§ 244.26 POLICE AND FIREFIGHTER’S DISABILITY AND PENSION CONTRIBUTION PICK-UP.
   (a)   Each full-time police officer on the village police force as of December 31, 2001 (except the current Police Chief) shall have deducted from their pay one-half of one percent of their salary as part of their employee contribution and the remaining full amount of the statutorily required employee contribution to the Ohio Police and Firefighter's Disability and Pension Fund shall be withheld from the gross pay of each such full-time police employee and shall continue to be "picked up" (assumed and paid to) the Police and Firefighter's Disability and Pension Fund by the village. This "pick up" by the village is and shall be designated as public employee contributions and shall be in lieu of contributions to the Police and Firefighter's Disability and Pension Fund by each such person or employee. No person subject to this "pick up" shall have the option of choosing to receive the statutorily required contribution to the Police and Firefighter's Disability and Pension Fund instead of having it "picked up" by the village or of being excluded from the "pick up."
   (b)   The village shall, in reporting and making remittance to the Police and Firefighter's Disability and Pension Fund, report that the public employee's contribution for each person subject to their "pick up" has been made by the village in lieu of contributions to such Police and Firefighter's Disability and Pension Fund by each such person and that such contributions are designated as public employees contributions.
   (c)   Council approves and orders for each full-time police employee of the village as of December 31, 2001, that the full amount of the statutorily required contribution to the Police and Firefighter's Disability and Pension Fund shall be withheld from the gross pay of each police officer who is a full-time employee of the village and shall be "picked up" (assumed and paid) to the Police and Firefighter's Disability and Pension Fund by the village. This "pick up" by the village is and shall be designated as public employee contributions and shall be in lieu of contributions to the Police and Firefighter's Disability and Pension Fund by each such employee. No person subject to this "pick up" shall have the option of choosing to receive the statutorily required contribution to the Police and Firefighter's Disability and Pension Fund instead of having it "picked up" by the village or of being excluded from the "pick up." The village shall also pay such employer contributions as are required by and in accordance with state law.
   (d)   Full-time police officers employed by the village after December 31, 2001 shall have 12.25 percent of their salary deducted and deposited by the village in the Police and Firefighter's Disability and Pension Fund as their employee's contribution in accordance with state law and the village shall make such employer contributions as required by and in accordance with state law.
   (e)   Part-time police shall pay the full amount of the required employee contribution to either the public employee retirement system or social security depending on which is required or permitted by law.
