§ 1-15-1 DISCRIMINATION BAN.
   (A)   The city does not discriminate on the basis of race, color, national origin, political affiliation, religion, age, sex or disability in the admission or access to, or treatment or employment in, its services, programs or activities. The city has designated a coordinator to facilitate compliance with the Americans with Disabilities Act of 1990 (ADA), being 42 U.S.C. §§ 12101 et seq., and § 504 of the Rehabilitation Act of 1973, being 29 U.S.C. § 794. In an effort to address employment related complaints, the city will provide a copy of the brochure titled Pre-Employment Inquiry Guidelines published by the Department of Fair Employment and Housing free of charge to any person who requests it.
   (B)   The city hereby adopts the following grievance procedure in order to provide for the prompt and equitable resolution of any discrimination related complaints.
      1.   City employees who have complaints alleging discrimination should refer to the grievance procedure as outlined in the city’s personnel rules and regulations. All other individuals can file a complaint with the City Manager’s office for review, action or referral to the appropriate outside agency. Complaints should be submitted in writing and addressed to the City Manager, City of Livingston, 1416 C Street, Livingston, CA 95334. A record of the complaint will be kept on file with the City Manager’s office.
      2.   The individual’s right to prompt and equitable resolution of the complaint shall not impair his or her pursuit of other remedies, such as the filing of a complaint with the U.S. Department of Justice or any other appropriate federal agency. Furthermore, the filing of a lawsuit in state or federal district court can occur at any time. The use of this grievance procedure is not a prerequisite to the pursuit of other remedies.
