§ 31.066 DISCONTINUANCE OF SUITS.
   The City Attorney shall not be required to prosecute any suit or action arising under the ordinances of the city, when, upon investigation of the same, he or she is satisfied that the complaint was instituted maliciously or vexatiously and without probable cause, or when, in his or her judgment, there is insufficient evidence to obtain a conviction; and he or she shall be authorized to discontinue any suit or proceeding upon those terms as he or she may deem best and equitable.
