§ 31.046 POWERS AND DUTIES.
   (A)   The City Administrator shall have custody and control of all documents, including debts, mortgages, leases, contracts, judgment orders, notes, bonds, and evidences of indebtedness belonging to the city, except those as are directed by law or ordinance to be deposited elsewhere. He or she shall have supervision of the issuance and sale of all bonds, warrants, and obligations. He or she shall have supervision over the accounting work of the city.
   (B)   The City Administrator shall direct, supervise, and coordinate the administration of all departments, offices, and agencies of the city, except as otherwise provided by law.
   (C)   The City Administrator shall recommend the appointment and, when necessary for the good of the service, the suspension or removal of all department heads of the city and shall have the authority to hire, suspend and/or remove all other city employees and appointive administrative officers except when otherwise provided for by law or by bargained agreement. All appointments and removals shall be based solely upon merit and on the qualifications or disqualifications of the individuals involved, without regard to race, sex, religious convictions or political belief or affiliation.
   (D)   The City Administrator shall attend all City Council meetings. The Administrator shall have the right to take part in all discussions but shall not vote.
   (E)   The City Administrator shall provide for the enforcement of all laws and ordinances within the city.
   (F)   The City Administrator shall assist the City Budget Officer in the preparation and submission to the City Council, by the date set by the Council, but prior to any deadlines set by statute, a recommended and sufficiently detailed annual budget for the city operations, a preparation of the levy for the city, and a recommended capital expenditure program. When the annual budget or capital program has been approved by the City Council, the City Administrator shall be responsible for the administration of that budget or capital program in conjunction with the Budget Officer of the city.
   (G)   The City Administrator shall give additional reports and information concerning the fiscal matters of the city as may from time to time be required by the City Council.
   (H)   The City Administrator shall make other reports as the City Council may require concerning the operations of the city departments, offices, and agencies.
   (I)   The City Administrator shall keep the City Council fully advised as to the present financial condition and future needs of the city.
   (J)   The City Administrator shall advise the City Council on pending decisions of public policy and recommend to the Council the adoption of those measures as the Administrator may deem necessary or expedient for the health, safety, or welfare of the community or for the improvement of administrative services.
   (K)   The City Administrator shall be responsible for procurement of commodities and services for all city departments, offices, and agencies and promulgate purchasing rules which shall be followed by employees in the procurement of goods and services. The City Administrator shall ensure that contracts executed by the city contain provisions consistent with any applicable approvals or restrictions authorized by the City Council.
   (L)   The City Administrator shall propose to the City Council those personnel rules and regulations as the Administrator deems necessary to manage the personnel policies of the city.
   (M)   The City Administrator shall be responsible for the conduct of all collective bargaining processes of the city, and recommend to the City Council collective bargaining agreements for consideration and possible final approval by the Council. The Administrator shall be responsible for administering all employee organization contracts reached through the collective bargaining process.
   (N)   The City Administrator shall provide staff support services for the Mayor and members of the City Council.
   (O)   The City Administrator shall develop, plan and coordinate implementation of programs to identify the resources of the community and to utilize those resources to develop and present information to business prospects and other economic development organizations to promote the advantages of investing in the community. The City Administrator shall also negotiate with industry representatives to encourage location in area, confer with governmental officials to effect changes in local policies or ordinances discouraging effective development, and conduct and direct activities such as research, analysis and evaluation of technical information to determine feasibility and economic impact of proposed expansions and developments. The City Administrator is not authorized, however, to independently commit or refuse to provide city services to other governmental/government entities, special districts or major commercial or industrial entities without the consent/concurrence of the City Council.
   (P)   The City Administrator shall perform those other duties as may be specified by law or city ordinance or as may from time to time be requested by the City Council.
   (Q)   The City Administrator shall each month cause to be prepared and shall present to the Council a statement showing the exact financial condition of the city as of the end of the preceding month.
   (R)   The City Administrator shall devote his or her entire time to discharge of his or her official duties.
