§ 111.39 SALE OF LIQUOR OUTSIDE BUILDING PROHIBITED; PERMIT TO SELL; REQUIREMENTS.
   (A)   No licensee of a liquor license issued by the City of Litchfield shall sell or deliver at retail any alcohol liquor for beverage purposes outside the building located on the licensed premises except as hereinafter provided. A violation of this section shall subject the offender to a penalty as provided in the Code of Ordinances of the City of Litchfield, and shall be cause for revocation of the license so issued.

   (B)   Permit to sell; requirements.
      (1)   Holders of Class A, C, E and F licenses may be issued a permit to sell alcoholic liquor, as authorized by each individual classification, outside of the permanent structure and on property where the licensee's permit structure is located, upon the following terms:
      (2)   For Class A, C and F liquor license holders, fencing of not less than 6 feet in height, and for Class E liquor license holders, fencing of not less than 3 feet in height made of wood or other similarities, shall be erected around the area where the alcoholic liquor is being sold or consumed. The fencing shall be designed and positioned so as to separate the licensee's patrons from the general public and to provide screening from viewing by the general public for those individuals occupying that area.
      (3)   Access into the outside area shall be from the permanent structure only and no access shall be permitted from the street, sidewalk, or adjoining property.
      (4)   No music of any kind may be played or broadcast from or to the outside area or within the permanent structure which is of a volume so as to disturb the neighborhood in any manner. Music shall not be played or broadcast after 10:00 p.m.
      (5)   For Class A, C and F liquor license holders, outdoor portable sanitary facilities must be provided by the licensee as required by local ordinance, state statutes or regulations, or county statutes or regulations.
      (6)   No sales of alcoholic liquor may be made from outside the permanent structure of the building. Point of sale must be made from inside the buildings. Service of liquor by staff may be made to the outside area. No sales shall take place from any adjoining property, public street, sidewalk, or alley. No alcoholic liquor shall be removed from the fenced area or permanent structure.
      (7)   Proof of dram shop insurance coverage on the permanent structure and the outside served area must be submitted with the completed application.
      (8)   Adequate security must be provided by the licensee.
      (9)   All outside activities of any type may not begin prior to 12:00 noon and will cease at 12:00 midnight.
