(A) The owner of record of a property on which there is any dead, dying, diseased, or infested tree must remove any such tree from the Village within ten (10) days of notification.
1. All dead, dying, diseased, or infested trees must be legally disposed of in compliance with state and federal regulations. It is unlawful for the owner, occupant, or agent of any property in the Village to permit any tree, portion thereof, including logs, infected with an infectious disease to remain on his or her property or to be retained for any use. Chipping of tree materials will be permitted provided that any material that is chipped must not exceed one square inch of final chip surface.
(B) The Village shall have the right to abate trees which violate the provisions of this Chapter. If the Village chooses to abate, the Village shall first serve by certified mail, return receipt requested, and by regular mail upon the owner of record at the address shown on the County tax rolls.
