8-5-4: INSPECTION AND SAMPLING:
   (A)   Village employees, officers, agents, and consultants are authorized to enter upon private property, subject to applicable law, for purposes of:
      1.   Inspecting trees on any such property having the appearance of or suspected of having:
         (a)   Dutch elm disease,
         (b)   Elm yellows disease (formerly called Phloem necrosis),
         (c)   Oak wilt,
         (d)   Pine wilt,
         (e)   Any other infectious disease,
         (f)   Exhibiting an infestation of the emerald ash borer (Agrilus planipennis Fairmaire),
         (g)   That appears dead or dying, regardless of cause,
         (h)   Parts thereof in a dead or dying condition which serve as a breeding place for the European elm bark beetle, Scolytus multistristus or other disease spreading insect, bug or vector, or
      2.   Taking samples as required to determine whether a tree is diseased or infested. (Ord. 2021-4934, 11-15-2021)
