A person or entity, including a telecommunications carrier, seeking to provide cable service or video service pursuant to this title shall not use the public rights of way for the installation or construction of facilities for the provision of cable service or video service or offer cable service or video service until it has obtained either: a) a state issued authorization from the commission to offer or provide cable or video service under section 401 of the cable and video competition law of 2007 1 ; or b) a cable franchise from the village under chapter 5 of this title and section 11-42-11 of the Illinois municipal code 2 . An operator providing cable or video service under a state issued authorization shall operate subject to chapter 5A of this title. An operation providing cable service under a village issued franchise shall operate subject to chapter 5 of this title. (Ord. 2007-4149, 11-5-2007)
