10-4-3: PERMITS REQUIRED; FEES:
   (A)   General: Except as hereinafter provided, it shall be unlawful for any person to park a motor vehicle in the above described village parking lots without first obtaining a permit. Certain spaces in certain lots may be, from time to time, designated by signs for purposes other than commuter parking or public parking purposes. The uses for which certain spaces may be designated shall include, but not be limited to, areas for village employees, handicapped parking, loading zones, Burlington Northern agent parking, visitors' parking, police use, or other specific uses as indicated by signs. For regulations pertaining to bicycles, refer to chapter 6 of this title.
      1.   Validity Of Permits; Transfer Prohibited:
         (a)   All permits required by this section shall be valid only for the permitted vehicle, which shall be owned or leased by the permittee and shall have a state license number assigned thereto. Two (2) vehicles may be registered under the same permit; provided, that both vehicles are owned or leased by the permittee and are registered in the village business office under the permittee's name. However, only one of said two (2) vehicles shall be allowed to use the permit at any one time.
         (b)   The transfer of any permit required herein between vehicles other than those registered to the permittee is strictly prohibited. Any attempt to transfer any permit required herein shall result in an automatic revocation of said permit and the imposition of a fine as hereinafter set forth. Further, if any person violates this subsection (A)1 while he is on the permit waiting list, he shall be automatically placed at the end of the waiting list for a parking permit in addition to paying any applicable fines.
      2.   Permit Issuance: The village reserves the right to issue permits based upon rules which, in the opinion of the corporate authorities, further the public health, safety, comfort, morals and welfare of its citizens, and which, in the opinion of the corporate authorities, are in the best interests of the village. Such rules may include giving priority to village employees, village residents or any other group of persons determined appropriate by the corporate authorities of the village.
      3.   Fee Increase: The village reserves the right to increase the fee due for a parking permit at any time prior to the effective date of the permit. Notification of the increase and the effective date thereof shall be deemed given upon passage of the ordinance modifying the fee.
      4.   Payment Of Fee Difference Required: Holders of permits which are not yet effective at the time a fee increase ordinance is passed shall pay to the village the difference between the new fee and amount previously paid for the permit.
   (B)   Categories: For purposes of issuing the parking permits prescribed herein, there shall be the following categories:
Category 1    Lots A, B, C, D and E.
Lots A, B, D, and E shall be operated as commuter parking lots for which quarterly parking permits are issued. A portion of lot C shall be operated as a commuter parking lot for which quarterly parking permits are issued. Other portions of lot C shall be designated by signage as employee parking and village hall visitor parking. When space is available, daily permits shall be issued for portions of lot C and lot E in a manner as determined appropriate by the business office manager.
Category 4    Lot G.
The aforementioned lot shall be used by the owners and operators of retail and other businesses and residents of multi-family units located in the central business district. As used in this subsection, the term central business district shall refer to that portion of the village bounded by Ogden, Garfield, Division and Center. In the issuance of parking permits for lot G, priority shall be given to such owners and operators of businesses and residents of multi-family units; however, if spaces remain available after being offered to business owners and operators and residents of multi-family units, the business office manager may issue permits to others, or provide free public parking as deemed appropriate by the business office manager.
   (C)   Fees And Purchasing Procedure:
      1.   Parking permits shall be obtained from the village of Lisle business office manager. Fees shall be as established by Title 1, Chapter 20, “Fees, Fines, Insurance, Guarantees, and Regulatory Measures”.
      2.   There is hereby established the following procedures for purchase of quarterly parking permits:
         (a)   Permits shall be paid for in full and obtained from the business office manager prior to five o'clock (5:00) P.M. on the last village business day of the quarter preceding the quarter for which the permit is to apply.
         (b)   Failure to pay for and obtain a parking permit by five o'clock (5:00) P.M. on the last business day of a quarter shall be deemed to be a forfeiture of the permittee's parking permit without further notice on the part of the village. However, if the permittee pays for and obtains the parking permit within the first five (5) business days of the quarter to which the permit applies, the business office manager, upon the payment of a late fee in the amount as established by Title 1, Chapter 20, “Fees, Fines, Insurance, Guarantees, and Regulatory Measures”, may reinstate and reissue the permit. Further, if the permittee pays for and obtains the parking permit within six (6) to fifteen (15) business days after the first day of the quarter to which it applies, the business office manager, upon the payment of a late fee in the amount as established by Title 1, Chapter 20, “Fees, Fines, Insurance, Guarantees, and Regulatory Measures”, may reinstate and reissue the permit. Upon the passage of fifteen (15) days following the first day of the quarter, the permittee forfeits all rights and privileges whatsoever in the permit and must reapply for a permit pursuant to subsection (D) of this section.
         (c)   Failure to pay to the village any increase in parking permit fees, as set forth in subsection (A)3 of this section, shall render the parking permit void.
         (d)   Any person who has failed to pay any ticket issued pursuant to this chapter, and due pursuant to the terms of this code, by five o'clock (5:00) P.M. on the last village business day of the quarter to which the current permit applies, shall be denied the issuance of a permit for the new quarter until such tickets are paid in full.
   (D)   Permit Application: Every owner or operator of a motor vehicle desiring a permit for such vehicle, shall file a permit application with the village business office setting forth the name and address of the applicant, the description of the vehicle for which the permit is desired, and the state license number of the vehicle for which the permit is desired. The applicant shall furnish proof of ownership and/or registration if it is requested by the village. Upon satisfactory completion and acceptance of the application and payment of the applicable permit fees hereinafter provided, the village may issue a permit. Upon the issuance of a permit by the village business office, the applicant shall be permitted to park said registered vehicle in the appropriate village parking lot until the expiration or revocation of such permit. In the event that no commuter parking permits are available for sale, the village of Lisle may at its discretion maintain a wait list for commuter parking permits as provided for in subsection (D)1 of this section. If any applicant uses or attempts to use a permit in connection with the parking of a vehicle not registered with the village business office; or if any applicant uses or attempts to use a permit in connection with the parking of a vehicle not owned or leased by said applicant; or if any applicant uses or attempts to use a permit in any manner not authorized by this chapter, the applicant shall be automatically placed at the end of the waiting list, the permit will be revoked and fines shall be imposed as hereinafter set forth.
      1.   In the event that no commuter parking permits are available for sale, the village of Lisle may at its discretion maintain a wait list for commuter parking permits. In order to be placed on the wait list an application must be submitted on a form provided by the business office and a fee paid as required by Title 1, Chapter 20, “Fees, Fines, Insurance, Guarantees, and Regulatory Measures”. The applicant must be the individual in whose name the permit will be issued. As permits are offered to those on the wait list, forty five percent (45%) of available permits must be offered only to incorporated village of Lisle residents in chronological order, with those residents on the list the longest being offered permits first, and the remaining fifty five percent (55%) of available permits offered without regard for residency in chronological order, with those on the list the longest being offered permits first.
   (E)   Refund: Any owner or operator of a motor vehicle having secured such a permit from the business office manager as provided in subsection (D) of this section may obtain a partial refund according to the schedule as established by Title 1, Chapter 20, “Fees, Fines, Insurance, Guarantees, and Regulatory Measures” if the owner or operator desires to cancel said permit at some time prior to its expiration.
   (F)   Display Of Permit: It shall be unlawful to park any motor vehicle in any of the above described village parking lots without displaying the permit required by this chapter in the following manner: 1) parking permits that are required to be affixed to the windshield shall be prominently displayed in the lower right hand corner (passenger's side) of the front windshield within a twelve inch (12") radius of said lower right hand corner; 2) parking permits that are required to be hung from the rearview mirror shall be hung from the rearview mirror in a prominently displayed manner, and in no event shall such permits be affixed to the rearview mirror or otherwise displayed in any manner contrary to this subsection. It shall be the permittee's obligation to securely affix or hang the required permit in the designated location as provided in this subsection.
Notwithstanding the foregoing, no permit need be acquired nor displayed while parking in lots B, C, D, and E for the period starting at two o'clock (2:00) P.M. to two o'clock (2:00) A.M. each day Monday through Thursday and from two o'clock (2:00) P.M. Friday to two o'clock (2:00) A.M. Monday. However, any vehicles parked at any location upon a municipal parking lot shall comply with all other parking restrictions and time limits as set forth in this chapter.
   (G)   Revenue: All revenues derived from the sale of permits as provided under this section shall be deposited in the general corporate fund of the village.
   (H)   Penalties, Fines:
      1.   Failure To Display Permit: Failure to display a permit on any permitted vehicle shall be determined to be a violation for which a fine as established by Title 1, Chapter 20, “Fees, Fines, Insurance, Guarantees, and Regulatory Measures” shall be assessed for each offense.
      2.   Failure To Secure Permit: Parking in any municipal parking lot without a valid permit shall be deemed a violation for which a fine as established by Title 1, Chapter 20, “Fees, Fines, Insurance, Guarantees, and Regulatory Measures” shall be assessed for each offense.
