7-8-3: OPERATIONS OF CONCESSIONS; GENERAL:
   (A)   The licensee must comply with all applicable Federal, State, and local laws, codes, ordinances, rules, and regulations.
   (B)   1. Prior to commencing business, the licensee shall provide:
         (a)   Proof of insurance required under the Workers' Compensation Act, or proof of exemption under 820 Illinois Compiled Statutes 305/3(20); and
         (b)   Proof of insurance for commercial general liability as established by Title 1, Chapter 20, “Fees, Fines, Insurance, Guarantees, and Regulatory Measures” combined single limit per occurrence for bodily injury, personal injury, and property damage; excessive liability in umbrella form may be provided to meet a portion of the required insurance.
      2.   For insurance required under this subsection:
         (a)   Name the Village, its President, Trustees, officers, employees, attorneys, agents, and volunteers, and the Burlington Northern Railroad, its officers, agents, and employees, as additional insureds; and
         (b)   It may not be canceled, permitted to expire, or be changed without thirty (30) days' advance notice to the Village Manager.
   (C)   Hours of operation of concessions within the Lisle Commuter Rail Station shall be limited to the hours established for the station's waiting room. The licensee may store a cart, table, or vending unit in the station when the cart, table, or vending unit is not in use, and at their sole and absolute risk; provided, however, that no such cart, table, or vending unit may be stored unless and until the licensee executes an agreement in a form provided by the Village in which the licensee agrees to indemnify and hold harmless the Village, its President, Trustees, officers, employees, attorneys, agents, and volunteers from and against any and all loss, cost, damage, or expense, including, without limitation, court costs and attorney fees, which any of them may suffer, incur, or sustain, or for which any of them may become liable by virtue of the injury to or the death of any person, or the damage to or loss, theft, or destruction of any property arising out of, or in connection with, the storage cart, table, or vending unit.
   (D)   Concession locations shall be determined and designated by the Village. Any concession area within the Lisle Commuter Rail Station shall occupy a space that does not exceed six feet by eight feet (6' x 8').
   (E)   The license is nonassignable and nontransferable without prior approval of the Village Board.
   (F)   The license shall be displayed at all times in a conspicuous place on the mobile vendor cart of the licensee.
   (G)   Proof of insurance shall be carried with the mobile vendor cart at all times.
   (H)   Notwithstanding anything to the contrary in this chapter, no license shall be entered into by the Village for any concession operation within the Lisle Commuter Rail Station unless and until such license is authorized in writing by the Northern and Santa Fe Railway Company.
