7-6-11: RIGHTS OF ACCESS:
   (A)   The village and its employees shall have ready access, to the extent allowed by law, to the premises, places or buildings where sewer service is supplied for the purpose of examining and testing the operation of the sewerage system, or any part thereof, and for the purpose of determining if any violation of the provisions of this chapter exists. Every user of said sewer shall take the same upon the conditions prescribed in this section.
   (B)   The failure to allow such access shall be grounds for the termination of water and sewer service, after notice and opportunity to be heard. In the event of a notice of termination to occupant, user or owner, prior to termination of service, the occupant, user or owner shall have ten (10) days within which to request, in writing to the village clerk, a hearing by the village manager or his designee. If no such request is made, water and sewer service may be immediately terminated by the village.
   (C)   In the event that the occupant, user or owner wishes to have reviewed any decision of the village manager or his designee with respect to termination of service, then he shall have the right to appeal to the village board of trustees for its determination and review of the decision of the village manager or his designee. Any decision not appealed from within the time hereinafter set forth shall be final.
   (D)   Any request for review of an adverse decision must be made in writing, addressed to the village president and board of trustees and must be made within ten (10) days after the decision and by filing same with the village clerk, who shall place the matter on the agenda of the next regularly scheduled meeting of the corporate authorities, whereas said matter shall be considered. At said hearing the village manager or his designee shall present his reasons for his decision. The occupant, user or owner shall also be heard. The president and board of trustees shall then make its decision and the village clerk shall cause it to be delivered to the occupant, user or owner within five (5) days, by personal service or certified mail. In the event that the decision upholds any termination, said termination shall take place not less than ten (10) days thereafter. (Ord. 95-2684, 9-5-1995)
