7-6-3: PRIVIES, CESSPOOLS:
   (A)   Prohibited: Use of cesspools, septic or other sewage tanks and privies is hereby prohibited, and no cesspool, septic tank or other sewage tank or privy shall be constructed on property accessible to a public sewer. The use of cesspools, septic or other sewage tanks and privies already constructed on property to which a public sewer is or becomes accessible shall be discontinued within two (2) months after the public sewer becomes accessible; and such cesspools, septic or other sewage tanks and privy vaults shall be cleaned out to within no less than twenty four inches (24") of the ground surface, and refilled with earth, cinders, ashes or similar material.
   (B)   Public Nuisance: Any cesspool, septic or sewage tank or privy constructed or maintained on any property in violation of the provisions of this section is hereby declared to be a public nuisance and shall, upon five (5) days' written notice to the owner of said premises, be abated. If the owner fails or refuses to abate said nuisance within five (5) days after receiving written notice thereof from the village, then the village shall abate said nuisance and the owners of the premises shall be liable to the village for the costs and expenses of abating the same.
