7-1A-3: INSTALLATION OF CULVERTS:
   (A)   The owner of any property located in the Village, on a street without curb and gutter shall, before the excavation in connection with the construction of any building on such property, provide and install a culvert under any driveway used for access to the property from such street. Such culvert shall be constructed of either reinforced concrete pipe, corrugated polyethylene pipe or corrugated galvanized steel no less than twelve inches (12") in diameter. The diameter of such culvert in any case shall be not less than equal to the diameter of the nearest road culvert upstream from said property. Pipe diameter shall be sized based on appropriate hydrologic and hydraulic calculations. All culverts shall be not less than twenty feet (20') long and shall be bedded and covered with crushed stone or gravel, and all temporary culverts will not be less than twenty feet (20') long and shall be covered with an adequate amount of crushed stone or gravel (not less than 8 inches) so as to provide a firm base for vehicles using same. The culvert shall be installed per the Village's standard details 1 .
   (B)   All building permits issued for residential construction shall be issued subject to the installation of such culvert, and no person shall be permitted to proceed with construction until such culvert has been installed. No person shall drive any vehicle from the public street onto property across any drainage without the installation of a culvert, as provided in this section.
   (C)   Any person violating this section shall be guilty of a misdemeanor and shall be fined as established by Title 1, Chapter 20, “Fees, Fines, Insurance, Guarantees, and Regulatory Measures”, and a separate offense shall be deemed committed upon each day that such violation continues.
