5-20-2: SETBACKS:
   (A)   Front Street Setbacks
      1.   Measurement. Front street setbacks are measured from the right-of-way line to the closest point of the building or structure.
      2.   Permitted Obstructions / Encroachments. Unless specifically authorized by this Ordinance, front street setbacks must be unobstructed from the ground to the sky.
      3.   Double Frontage Lots. On double-frontage lots, the Zoning Administrator is authorized to establish which of the frontages constitutes the front lot line (and is thereby subject to front street setback regulations) based on factors such as the pattern of front and rear yards on the subject block, existing limitations on street access, where the building’s “front” door is located or other reasonable considerations. Only such obstructions permitted in front street setback may be located in that part of a rear setback adjoining a street that is equivalent in depth to a required front setback, except for lots backing to thoroughfares in subdivisions where no-access strips have been provided on the recorded plat.
      4.   Front Street Exceptions. When existing buildings on one or more abutting lots are closer to the street property line than the otherwise required street setback, additions to existing residential buildings or construction of new residential buildings on the subject lot may comply with the average street yard depth that exists on the nearest 2 lots on either side of the subject lot instead of complying with the zoning district’s minimum street setback requirement.
         (a)    If one or more of the lots required to be included in the averaging calculation is vacant, the vacant lot will be deemed to have a front street yard depth equal to the minimum street setback requirement of the subject zoning district.
 
         (b)    Lots with frontage on a different street than the subject lot or that are separated from the subject lot by a street or alley may not be used in computing the average.
 
         (c)    When the subject lot is a corner lot, the average street yard depth will be computed on the basis of the nearest 2 lots with frontage on the same street as the subject lot.
 
         (d)   When the subject lot abuts a corner lot with frontage on the same street, the average street yard depth will be computed on the basis of the abutting corner lot and the nearest 2 lots with frontage on the same street as the subject lot.
   (B)   Side Street Setbacks
      1.   Measurement. Side street setbacks are measured from the right-of-way line to the closest point of the building or structure.
      2.   Permitted Obstructions / Encroachments. Unless specifically authorized by this Ordinance, side street setbacks must be unobstructed from the ground to the sky.
      3.   The zoning administrator is authorized to establish which of the frontages constitutes the side street (and is thereby subject to side street setback regulations) based on factors such as the pattern of front yards on the subject blockface, existing limitations on street access, where the building’s “front” door is located or other reasonable considerations.
   (C)   Rear Setbacks
      1.   Measurement. Rear setbacks are measured from the rear property line to the closest point of the building or structure.
         (a)   In subdivisions improved with townhouses, duplexes, or multi-unit buildings, or in cases in which individual fee simple lots are surrounded by common area, the rear setback shall be measured to the perimeter of the subdivision.
      2.   Permitted Obstructions / Encroachments. Unless specifically authorized by this Ordinance, rear setbacks must be unobstructed from the ground to the sky.
      3.   Corner Lots. No rear setback is required on corner lots. A corner lot shall have a front street, side street, and two side setbacks.
   (D)   Side Setbacks
   1.   Measurement. Side setbacks are measured from the interior or side lot line to the closest point of the building.
      (a)   In subdivisions improved with townhouses, duplexes, or multi-unit buildings, or in cases in which individual fee simple lots are surrounded by common area, the side setback shall be measured to the perimeter of the subdivision.
   2.   Permitted Obstructions / Encroachments. Unless specifically authorized by this Ordinance, side setbacks must be unobstructed from the ground to the sky. (Ord. 2021-4931, 11-15-2021)
