3-8-14: APPLICATION FOR AND ISSUANCE OF CAB COMPANY OR LIVERY COMPANY LICENSE:
Each cab company or livery company shall apply to the business office manager for a cab company or livery company license before operating any taxicabs or public limousines within the village. The application for a cab company or livery company license shall be approved by the village manager and a cab company or livery company license issued pursuant to the following rules and regulations: (Ord. 2005-3935, 6-20-2005)
   (A)   An application shall be submitted to the business office manager along with payment of an initial first year nonrefundable application fee and an annual license fee as established by Title 1, Chapter 20, “Fees, Fines, Insurance, Guarantees, and Regulatory Measures”. Renewal applications shall be subject to the deadlines and late fees as established by Title 1, Chapter 20, “Fees, Fines, Insurance, Guarantees, and Regulatory Measures”.
There shall be no refund of any portion of the annual license fee imposed under this chapter for any portion of a year during which the licensee ceases to operate a taxi or livery company within the village. (Ord. 2009-4257, 6-1-2009; amd. Ord. 2021-4921, 9-20-2021)
   (B)   The cab company or livery company shall be required to include in the application a true statement of certain facts including, but not limited to, the state of incorporation if the cab company or livery company is a corporation; whether the cab company or livery company is organized and qualified to do business under the laws of the state of Illinois if the cab company or livery company is a corporation; principal place of business; the names of the individuals who own the cab company or livery company; whether the cab company or livery company, if not a corporation, is a limited liability company, partnership, or sole proprietorship, or other type of business organization; the registered agent of the corporate cab company or livery company; principal office if different than principal place of business; and all such other information as requested by the application form as amended from time to time.
   (C)   The cab company or livery company shall be required, with its application for a license, to register each taxicab or public limousine operated by such company within the village by providing the following information:
      1.   The year, make, color and serial number;
      2.   The actual owner of the taxicab or public limousine;
      3.   Written certification that required inspections of each taxicab and each taximeter or public limousine have been completed within sixty (60) days of such application and that these inspections have demonstrated each taxicab or public limousine to be safe, and that each taximeter is in proper working order and accurate;
      4.   The name, address, and home phone number of each driver;
      5.   A valid and current state of Illinois operator's or chauffeur's license number and license expiration date for each driver; and
      6.   A schedule of rates of fares, fees or charges.
   (D)   The chief of police shall investigate the owners of the applicant cab company or livery company to determine the good character and business reputation of those owners and shall report his findings to the business office manager before issuance of a license. If this investigation uncovers information showing that any owners have been convicted of a felony, have not paid a judgment against them, or have misrepresented facts in the application for a license, the village manager shall not approve such application and no license shall be issued.
   (E)   The cab company or livery company shall be required to file with the business office manager, along with its application for a license, a certificate of insurance showing that the cab company or livery company, its drivers and employees, are adequately insured against public liability, property damage, and workers' compensation claims on account of its operation of taxicabs or public limousines in the village.
   (F)   Failure to fully comply with the application and disclosure requirements of this section shall constitute grounds for the business office manager to deny issuance of a license. (Ord. 2005-3935, 6-20-2005)
