3-2-1: DEFINITIONS:
Unless the context otherwise requires, the words and phrases herein defined are used in this chapter in the same meaning given them in the following definitions:
ALCOHOL:
The product of distillation of any fermented liquid, whether rectified or diluted, whatever may be the origin thereof, and includes synthetic ethyl alcohol. It does not include denatured alcohol or wood alcohol.
ALCOHOL, POWDERED:
Any powder or crystalline substance containing "alcohol", as defined in this section, produced for human consumption.
ALCOHOLIC LIQUOR:
Includes "alcohol", "spirits", "wine" and "beer" and every liquid or solid, patented or not, containing alcohol, spirits, wine or beer and capable of being consumed as a beverage by a human being. The provisions of this chapter shall not apply to alcohol used in the manufacture of denatured alcohol produced in accordance with acts of congress and regulations promulgated thereunder, nor to any liquid or solid containing one-half of one percent (0.5%) or less of alcohol by volume.
BEER:
A beverage obtained by the alcoholic fermentation of an infusion or concoction of barley, or other grain, malt and hops in water, and includes among other things, beer, ale, stout, lager beer, port and the like.
CHAMPAGNE:
Any "wine", as defined herein, further characterized by effervescence caused by fermentation and consequent generation of carbon dioxide.
LICENSED PREMISES:
Every building, establishment, structure, place of business or location, whether or not enclosed from the elements, owned or leased by the licensee, having been designated on the license application as the location for the operation of the licensed business, for which a current license is in effect.
MANAGER, ASSISTANT MANAGER, PART TIME OR TEMPORARY MANAGER:
Any person whose full time, part time or temporary activities include any of the following: a) overseeing the operation of a liquor establishment; b) ordering, receiving or managing liquor inventory; c) hiring, training or supervising bartenders, servers or sellers of liquor products; d) paying employees or suppliers; e) responding to customer complaints related to liquor establishment operations; f) communicating on behalf of the liquor license holder with the Local Liquor Commissioner, Village staff or representatives of other associated agencies. If more than one person performs all or any of the above functions, each such person shall be deemed a manager, assistant manager or temporary manager.
PACKAGE STORE:
A commercial retail establishment that conducts the sale of alcoholic products in their original unopened packages.
RETAILER:
A business that sells and offers for sale at retail, only at the premises specified in such license, alcoholic liquor for use or consumption, but not for resale in any form.
SALE OR SELL:
Any transfer, exchange or barter in any manner, or by any means whatsoever, including, but not limited to, a transaction involving the internet, telephone, mail, facsimile, or any other electronic means, by any person, whether principal, proprietor, agent, servant or employee. The taking of an order for immediate or future remote delivery shall also be deemed a sale.
SPECIALITY RETAILER:
A business which conducts alcohol sales at a location not owned or leased by such business, or in a manner in which liquor is specially packaged (i.e. as part of a gift basket).
SPIRITS:
Any beverage which contains alcohol obtained by distillation, mixed with water or other substance in solution, and includes brandy, rum, whiskey, gin or other spirituous liquors, and such liquors when rectified, blended or otherwise mixed with alcohol or other substances.
TASTING:
A supervised presentation of alcoholic products to the public at an off premises licensed retailer for the purpose of disseminating product information and education, with consumption of alcoholic products being an incidental part of the presentation. Tastings must be free of charge.
TAVERN:
Any public place kept, used, maintained, advertised and held out to the public as a place where alcoholic liquor is offered for sale to the public for consumption on the premises or for consumption off the premises when sold to the public in its original package. The service of food or meals is incidental to the service of alcoholic liquor.
WINE:
Any alcoholic beverage obtained by the fermentation of the natural contents of fruits, vegetables, or honey, containing sugar, including mead and such beverages when fortified by the addition of alcohol or spirits, as defined herein.
