2-1-8: STAY OF PROCEEDINGS:
An appeal shall stay all proceedings in furtherance of the action appealed from, unless the building commissioner certifies to the planning and zoning commission after the notice of appeal has been filed with him that, by reason of facts stated in the certificate, a stay would, in his opinion, cause imminent peril to life or property, in which case the proceedings shall not be stayed otherwise than by a restraining order granted by the planning and zoning commission, or by a court of record, on application or notice to the building commissioner on due cause shown.
The planning and zoning commission shall fix a reasonable time and place for the hearing of the appeal, shall give due notice thereof to the parties in interest, and shall render a decision within a reasonable time.
Any person may appear and testify at the hearing, either in person or by duly authorized agent or attorney. (Ord. 2003-3451, 4-7-2003, eff. 5-1-2003)
