For the purposes of this chapter, the following definitions shall apply unless the content indicates or requires a different meaning.
OPERATOR.
Every individual who shall operate a vehicle as the owner thereof or as the agent, employee, or permittee of the owner.
(1) It shall be unlawful for any person to cause, allow, permit, or suffer any vehicle registered in his or her name or operated or controlled by him or her to operate over or upon any street in the City of Linton a vehicle, the gross weight of which is in excess of 8,000 pounds unless the street shall be marked as a heavy weight vehicle route.
(2) The Board of Public Works and Safety of the City of Linton shall designate suitable and convenient routes within the city over which vehicles in excess of the 8,000-pound weight limit may be diverted and shall provide that these routes be appropriately marked.
(3) The Board of Public Works and Safety of the City of Linton, Indiana, is authorized to issue permits to exceed the allowable weight limit upon proper application by persons upon forms prescribed by the Board of Public Works and Safety and upon the payment by the persons of the fees as may be designated by the Board of Public Works and Safety. The Board of Public Safety shall promulgate a table of rate charges for the issuance of the permits which rates shall fairly compensate the City for damages caused to the streets by the overweight vehicles.
(4) All permit fees paid under this section shall be paid by the Clerk-Treasurer of the City of Linton into the Street Dep artment Fund of the City.
(5) This section shall take effect and be in force on and after its passage, approval, and publication as provided by law.
PERSON.
Any individual, firm, partnership, or corporation.
STREET.
Any public street, avenue, road, boulevard, highway, or other public place located in the City of Linton, Indiana, and established for the use of vehicles, except highways in the state highway system and the state maintained routes through the City of Linton, Indiana.
VEHICLE.
Any device by which any person or property may be transported upon a public highway, except those operated upon rails and permanent tracks, and excepting those used exclusively by human power.
