Any person who violates this Section 94.16 and fails to abate the nuisance after proper notice having been issued and the expiration of the time specified in the notice, which period shall not be less than ten days, shall be found to be harboring a nuisance, and will be fined $500.
If, after notice of the violation is served upon the landowner, and the landowner fails to abate the nuisance within the time required by the notice, or within a time extended as a result of an appeal or of an extension being granted by the Board, the City will have a limited right of entry onto the landowner's property to abate the nuisance. If the City exercises its Option to Abate, the City will levy the fine in accordance with this Section, which fine shall be in addition to any costs billed to the landowner as costs of abatement.
