(1) Inspection permitted. The Department may inspect, at any time, a permittee's collocation of a small wireless facility or installation or replacement of a wireless support structure. The Department shall determine during an inspection whether the permittee's small wireless facility or wireless support structure is in accordance with the requirements of the permittee's applicable small wireless facility permit and other applicable law.
(2) Suspension of activities. During an inspection, if the Department determines that a permittee has violated any material term of the permittee's small wireless facility permit or this chapter, the Department may suspend the permittee's small wireless facility permit. The Department shall provide prompt written notice of any suspension to a permittee, including the violations giving rise to the suspension. A suspension under this division is effective until a permittee corrects the alleged violation(s), at the permittee's sole expense. If the violation(s) are not corrected within 30 days after the date of such notice, the small wireless facility or wireless support structure shall be subject to removal in accordance with § 305.11 (Removal of a Small Wireless Facility or Wireless Support Structure). A permittee may appeal any suspension issued under this division to the Department as provided in § 305.12 (Appeals).
