(1) Removal permitted. The Department may remove, at permittee's expense, or require a permittee to remove, any small wireless facility or wireless support structure if:
(a) The small wireless facility permit or wireless support structure permit is revoked under this chapter or expires without renewal; or
(b) The small wireless facility or wireless support structure is designated by the Department as abandoned under § 305.10 (Abandonment).
(2) Notice to permittee; time to remove. The Department shall provide written notice to the permittee that it must remove a small wireless facility or wireless support structure under this section, including the reasons therefor. If the permittee does not remove the small wireless facility or wireless support structure within 30 days after the date of such notice, the Department may remove it at the permittee's expense without further notice to the permittee.
